OneManZoo Licensing Terms & Conditions
1. AGREEMENT
The use of any digital files produced by OneManZoo and sold or freely distributed through the
www.onemanzoo.com website is regulated by the following 'OneManZoo Licensing Terms & Conditions'.
By making any purchase or by downloading any free icons from the www.onemanzoo.com website,
you (the “purchaser” and the “Licensee”) agree with the 'OneManZoo Licensing Terms & Conditions'
set by OneManZoo* (the “Licensor”).
2. OWNERSHIP
All the copyrights, licensing rights, ownership rights and any other intellectual rights belong exclusively
to S.C. Respiro Media S.R.L., the legal owner of OneManZoo*
and of all the digital works presented on the www.onemanzoo.com website.
3. LICENSE
OneManZoo* (the “Licensor”) grants the purchaser (you, the “Licensee”)
a non-exclusive and non-transferrable worldwide license/right to use
the purchased digital items according to one of the following license types:
a. STANDARD LICENSE
The digital files under Standard License can be used ('as they are' or modified) as organic parts**
of a custom design work, as follows:
a.1. In personal and commercial projects: digital projects and digital advertisement on web,
video & any other digital platform.
a.2. In personal and commercial projects: printed projects and printed advertisement, such as business cards,
brochures, catalogues etc.
Standard License Prohibitions
a.3. The digital files under Standard License can NOT be used in:
- digital products destined for wide distribution and/or sale, such as templates, softwares,
e-cards, e-books, e-brochures etc.
- printed products destined for wide distribution and/or sale, such as calendars, books, t-shirts, mugs etc.
a.4. The digital files produced and sold by OneManZoo* through the www.onemanzoo.com website,
under Standard License and/or Extended License, can NOT be used in logo design projects.
a.5. The digital files produced and sold by OneManZoo* through the www.onemanzoo.com website,
can NOT be included in personal and/or in collective portfolios as stand alone design item.
a.6. The digital files produced and sold by OneManZoo* through the www.onemanzoo.com website,
can NOT be sold, resold, licensed, sub-licensed and/or freely distributed.
b. EXTENDED LICENSE
The digital files under Extended License can be used ('as they are' or modified) as organic parts**
of a custom design work, as follows:
b.1. In personal and commercial projects:
digital projects and digital advertisement on web, video & any other digital platform.
b.2. In personal and commercial projects:
printed projects and printed advertisement, such as business cards, brochures, catalogues etc.
b.3. In digital products destined for wide distribution and/or sale,
such as templates, softwares, e-cards, e-books, e-brochures etc.
b.4. In printed products destined for wide distribution and/or sale,
such as calendars, books, t-shirts, mugs etc.
Extended License Prohibitions
b.5. The digital files produced and sold by OneManZoo* through the www.onemanzoo.com website,
under Standard License and/or Extended License, can NOT be used in logo design projects.
b.6. The digital files produced and sold by OneManZoo* through the www.onemanzoo.com website,
can NOT be included in personal and/or in collective portfolios as stand alone design item.
b.7. The digital files produced and sold by OneManZoo* through the www.onemanzoo.com website,
can NOT be sold, resold, licensed, sub-licensed and/or freely distributed.
IMPORTANT!
The font used to describe a certain thematic category in some of the vector sets is Viga, a Google web font.
It is delivered with some vector sets as outlined graphic object and it is a FREE element besides
the paid digital content. All rights associated to this font belong to Google, its legal owner.
4. LICENSING PROOF
As the products sold by OneManZoo* through the www.onemanzoo.com website are transferable digital files,
the purchaser (you, the “Licensee”) has the OBLIGATION to store all the emails associated to the purchasing of a given
digital product, as digital proofs for the quality of “Licensee”. Any kind of copyright, legal and non-legal disputes
will be sold exclusively based on the “Licensee” quality. The “Licensee” quality will have to be proved
by forwarding to OneManZoo* the email(s) the purchaser received at purchasing.
In case the purchaser (you, the “Licensee”) can not prove his/her “Licensee” quality by forwarding to OneManZoo*
the email(s) the purchaser received at purchasing, OneManZoo* can NOT establish and confirm the “Licensee” quality
and OneManZoo* has NO MORAL AND LEGAL OBLIGATIONS to the given person.
For Limitation of Liability regarding Licensing Proof see 6.c.
5. FREE FILES
The digital files from the 'FREE Icons' section can be used for FREE in any kind of personal
and commercial projects, without any limitation.
Even so...
a. The digital files produced and freely distributed by OneManZoo* through the www.onemanzoo.com website,
can NOT be included in personal and/or in collective portfolios as stand alone design item.
b. The digital files produced and freely distributed by OneManZoo* through the www.onemanzoo.com website,
can NOT be sold, licensed and/or re-distributed.
6. LIMITATION OF LIABILITY
a. The purchaser (you, the “Licensee”) understands and agrees that in no event shall OneManZoo* (the “Licensor”)
be liable for any direct, indirect, punitive, incidental, exemplary or consequential losses, damages, claims, expenses
and legal actions which might be associated with and/or might arise from the use of the digital files produced,
sold and/or freely distributed by OneManZoo* through the www.onemanzoo.com website.
b. OneManZoo* (the “Licensor”) can NOT be held legally responsible for any damages, losses and costs that
might arise from the modifications made by the purchaser (you, the “Licensee”) on the digital files produced
and sold by OneManZoo* through the www.onemanzoo.com website.
c. OneManZoo* can NOT be held legally responsible for the damage and/or loss of the email(s) associated
to the purchasing of a given icon set, email(s) which prove(s) the “Licensee” quality of the purchaser.
d. OneManZoo* reserves the right to elect at a later date to revoke or amend the license granted by this
'OneManZoo Licensing Terms & Conditions' and replace the Content with an alternative for any reason.
7. ACKNOWLEDGEMENT
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND HAD AN OPPORTUNITY TO SEEK
INDEPENDENT LEGAL ADVICE PRIOR TO AGREEING TO IT. IN CONSIDERATION OF ONEMANZOO* AGREEING TO PROVIDE
THE CONTENT, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.
YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU
AND ONEMANZOO*, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER
COMMUNICATION BETWEEN YOU AND ONEMANZOO* RELATING TO THE SUBJECT OF THIS AGREEMENT.
